Lidar Coalition Welcomes NHTSA’s Proposed Rule on Automatic Emergency Braking Requirements for New Vehicles

Applauds Focus on Performance in Dark Lighting Conditions to Prevent Pedestrian Injuries and Fatalities
Washington, D.C., May 31, 2023 – The Lidar Coalition welcomes the National Highway Traffic Safety Administration’s Notice of Proposed Rulemaking that would require automatic emergency braking (AEB) and pedestrian AEB systems on new passenger cars and light trucks.
The Coalition is pleased that the proposed rule would require that systems are able to avoid pedestrian crashes at night by requiring performance under both daylight and darkness lighting conditions, and at high speeds.
“We applaud NHTSA’s focus on protecting pedestrians, especially in low-light conditions when they are most vulnerable,” said Ariel Wolf, counsel to the Lidar Coalition and chair of Venable LLP’s Autonomous and Connected Mobility Group.
“The Coalition looks forward to participating in the rulemaking process and engaging with NHTSA and other stakeholders to support a final rule that makes our roadways safer for all road users.”
The proposed rule notes that more than three-fourths of all pedestrian fatalities occur in conditions other than daylight. A review by the Insurance Institute for Highway Safety concluded that improving AEB performance at night would enhance safety for pedestrians.
